This site addresses the issue in detail and focuses on the true story of two brothers who are currently awaiting trial and facing deportation. Tragically, their story is far from unique.

In the 2013 CNN interview below, Attorney Raul Rayes notes the following when asked how it is that Manuel and Valente served in the military in Vietnam and became at risk for deportation 20 years later:

Manuel and Valente’s mother was an American Citizen. American case law is very clear. If you are the child of an American Citizen, even if you were born abroad, you are an American. Mitt Romney’s father was born in Mexico but it was never questioned that he is an American. Manuel and Valente served in Vietnam even when many other Americans refused or resisted doing so. The triggers in this case were minor infractions that occurred when the returned from Vietnam, and with PTSD no doubt. There are members of Congress today who have misdemeanors- none of them have lost their Citizenship.
